WORKFLEX GENERAL TERMS AND CONDITIONS
INTRODUCTION
WorkFlex Africa LLC (“Company”, “WorkFlex”, “we”, “our”, or “us”) operates an online marketplace platform accessible via www.workflex.africa and related applications or digital channels (the “Online Platform”).
The Online Platform connects individuals and businesses seeking services (Clients) with independent professionals (Service Providers) who offer various services.
WorkFlex does not itself provide the services listed on the platform and acts solely as a technology platform facilitating connections and bookings between Clients and Service Providers.
By accessing or using the Online Platform, you agree to be bound by these General Terms and Conditions.
If you do not agree to these terms, you must discontinue use of the platform immediately.
DEFINITIONS
Client
Any individual or organization requesting services through the Online Platform.
Service Provider
An independent contractor or business offering services through the Online Platform.
Job
A service engagement booked by a Client through the Online Platform to be performed by a Service Provider.
Job Posting
The order details provided to a Service Provider containing all relevant information regarding the service requested.
Premises
The physical or virtual location where the Service is performed.
Recipient
The person receiving the Service, which may or may not be the Client.
Online Platform
The WorkFlex website, mobile applications, or digital interfaces used to facilitate bookings.
Personal Data
Any information relating to an identifiable individual including name, address, phone number, identification documents, photos, and other identifying information.
NATURE OF THE PLATFORM
WorkFlex operates as a digital marketplace and intermediary platform.
WorkFlex:
- connects Clients with Service Providers
- facilitates booking and scheduling
- processes payments where applicable
- manages platform safety and compliance
WorkFlex does not employ Service Providers.
Service Providers operate as independent contractors responsible for their own professional conduct, taxes, licensing, and compliance with Nigerian law.
ELIGIBILITY
Users must:
- be at least 18 years old
- provide accurate and verifiable information
- comply with all applicable Nigerian laws and regulations
WorkFlex reserves the right to suspend or terminate accounts that provide false information.
SERVICE PROVIDER VERIFICATION
Service Providers may be required to submit verification documents including:
- government identification (e.g. National Identification Number – NIN)
- proof of address
- professional licenses or certifications
- background checks where required
WorkFlex reserves the right to approve, reject, or suspend any Service Provider application at its sole discretion.
BOOKINGS AND JOB ALLOCATION
Clients may book services through the Online Platform.
Job assignments to Service Providers depend on:
- availability
- skill requirements
- location
- client preferences
WorkFlex does not guarantee a minimum number of jobs to any Service Provider.
PAYMENT TERMS
All fees on the Online Platform are displayed in Nigerian Naira (NGN).
Service fees typically include:
- Service Provider hourly rate
- WorkFlex platform service fee or commission
- applicable taxes
Payments may be processed through third-party payment providers.
WorkFlex may temporarily hold payments to resolve disputes or verify completion of services.
Service Providers are responsible for their own tax obligations under Nigerian law.
CANCELLATION AND REFUND POLICY
The following cancellation policy applies:
More than 24 hours before Job start
- Full refund to Client
- No payment to Service Provider
Within 24 hours before Job start
- Client charged 25% of booking value
- 20% paid to Service Provider
After Job has started
- No refund unless otherwise determined by WorkFlex
Refunds may be adjusted based on the number of hours actually completed.
WorkFlex reserves the right to review disputes and determine fair resolution.
PLATFORM FEES
WorkFlex may charge:
- service fees
- booking fees
- platform commissions
These fees will be clearly displayed before confirmation of a booking.
WorkFlex reserves the right to update fees at any time with notice on the platform.
USER CONDUCT
Users agree not to:
- misuse the platform
- engage in fraud or deception
- harass other users
- bypass the platform to avoid fees
- provide illegal or harmful services
WorkFlex may suspend or permanently ban users who violate these rules.
LIMITATION OF LIABILITY
To the fullest extent permitted by Nigerian law:
WorkFlex shall not be liable for any damages, losses, or injuries arising from services performed by Service Providers.
WorkFlex’s role is limited to facilitating connections and bookings.
Clients engage Service Providers at their own risk.
INDEMNIFICATION
Service Providers agree to indemnify and hold harmless WorkFlex and its employees, directors, and partners against any claims resulting from:
- negligence
- misconduct
- breach of law
- breach of these Terms
DATA PROTECTION AND PRIVACY
WorkFlex processes Personal Data in accordance with:
- the Nigeria Data Protection Act (NDPA)
- the Nigeria Data Protection Regulation (NDPR)
Personal Data may be collected for:
- identity verification
- booking management
- payment processing
- customer support
- marketing communications
Users consent to the collection and processing of their Personal Data for these purposes.
WorkFlex implements appropriate security measures to protect user data.
INTELLECTUAL PROPERTY
All content on the Online Platform including:
- branding
- logos
- text
- graphics
- software
is the exclusive property of WorkFlex Africa LLC.
Users may not reproduce, distribute, or modify any platform content without written permission.
The brand WorkFlex remains the sole property of the Company.
TERMINATION
WorkFlex may suspend or terminate accounts for:
- violation of these Terms
- fraudulent activity
- misconduct
- legal compliance requirements
Users may terminate their accounts at any time.
DISPUTE RESOLUTION
WorkFlex encourages parties to resolve disputes through internal mediation via the platform.
If disputes cannot be resolved informally, they may be submitted to binding arbitration or the competent courts of Nigeria.
GOVERNING LAW
These Terms shall be governed by and interpreted in accordance with the laws of the Federal Republic of Nigeria.
Any legal action shall be brought before the courts of competent jurisdiction in Nigeria.
MODIFICATIONS TO TERMS
WorkFlex reserves the right to modify these Terms at any time.
Updated Terms will be posted on the Online Platform and continued use of the platform constitutes acceptance of the updated Terms.
